Tivice Evans and Ahzariyah Yasharahla were charged by the Tacoma police department with custodial interference and second-degree kidnapping charges on Feb 26, 2009. The charges were filed after an un-identified neighbor claimed that beating and screaming was heard and the department of social services was contacted. The Tacoma police were also called.

According to Achote Evans and Ach Yasharahla, the initial investigative report by Tacoma police found no evidence of abuse.

According to Seattle times, Yasharahla told a Tacoma police detective that he struck the boy with a belt because it was his culture to "discipline children harshly so that they would not be disrespectful when they get older," according to a court document obtained by KIRO 7 Eyewitness News.

Yasharahla disputs that report. The video of his extended interview with the news media can be found here: http://www.king5.com/video/featured-index.html?nvid=333625

According to Ahzariyah it is a case of misunderstanding and mis identification with another family that stayed next to them.

The children were taken into custody earlier this month after Ms. Evans agreed to hand the children over to the Tacoma police. According to the family the intial review of the lesions found on one of the children was ruled in-conclusive as to evidence of child abuse by the hospital. Evans and Ahzariya  visted the children at the DSHS office and they took their children back.

An amber alert was then issued for the children. Intial reports are that detectives wanted to make sure the children was safe.  A warrant was issued for both Tivice and  Yasharahla .  Yasharahla is charged with second-degree kidnapping and second-degree child assault. Yasharahla  was taken in to custody and the court set his bond at $250,000.
